Vendor Terms and Conditions

These Vendor Terms and Conditions ("Agreement") govern your use of the services provided by Budget Bashes as a vendor, including the listing of services, interactions with customers, and all associated activities.

1. Acceptance of Terms

By registering as a vendor on Budget Bashes, you agree to comply with and be bound by these Terms and Conditions, which form a legally binding agreement between you ("Vendor") and Budget Bashes ("Platform"). If you do not agree to these terms, you should discontinue use of the Platform immediately.

2. Vendor Responsibilities

• Accurate Listings: Vendors must provide accurate, complete, and up-to-date information regarding the services offered. Misrepresentation of services may result in suspension or termination of your account.
• Compliance with Law: Vendors are solely responsible for ensuring that their services comply with all applicable laws, regulations, and professional standards in the jurisdiction where the services are provided.
• Customer Service: Vendors agree to deliver services in a professional manner and resolve any disputes with customers amicably and in good faith.

3. Fees and Payments

• Commission: The Platform may charge a commission on transactions made through the Platform. The specific commission rate and payment terms will be displayed during the registration process and may vary based on the type of service offered.
• Payment Terms: Vendors will receive payments through the Platform after deducting the applicable commission and any fees (e.g., transaction fees). Payments will be processed within the contract terms discussed after the completion of the event/service.

4. Cancellation and Refunds

• Vendor-Initiated Cancellations: In case the Vendor cancels a booking, any payments made by the customer will be refunded in full. Frequent cancellations may result in account suspension.
• Customer-Initiated Cancellations: The Vendor agrees to honor any refunds as per the cancellation policy chosen during service listing.

5. Performance Standards and Reviews

• Service Delivery: Vendors agree to deliver services as advertised and on the agreed-upon schedule. Non-performance or failure to deliver services may result in negative reviews or removal from the platform.
• Reviews and Feedback: Vendors acknowledge that customers can rate and review services. Vendors may not manipulate reviews or ratings in any way, and the Platform reserves the right to remove reviews if deemed necessary.

6. Termination

• Voluntary Termination: Vendors may terminate their account at any time by providing written notice to Budget Bashes.
• Platform-Initiated Termination: The Platform reserves the right to suspend or terminate Vendor accounts at any time, with or without cause, including but not limited to violations of these Terms and Conditions.

7. Intellectual Property

Vendors grant the Platform a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, and display the Vendor’s name, logo, and service descriptions for the purposes of promoting the Vendor’s services on the Platform.

8. Limitation of Liability

To the maximum extent permitted by law, the Platform is not liable for any direct, indirect, incidental, or consequential damages that arise from the use of the Platform or the services provided by Vendors.

9. Confidentiality

Vendors agree to keep confidential all proprietary information related to the Platform’s operations and customers, including pricing, processes, and other sensitive information, except as required by law.

10. Amendments to Terms

Budget Bashes reserves the right to modify these Vendor Terms and Conditions at any time. Vendors will be notified of any significant changes via email or in-app notifications. Continued use of the Platform constitutes acceptance of the updated terms.

11. Governing Law

This Agreement is governed by the laws of Australia. Any disputes arising out of this Agreement will be subject to the exclusive jurisdiction of the courts of Australia.

13. Miscellaneous

Entire Agreement: These Terms and Conditions, along with the Privacy Policy, constitute the entire agreement between the Vendor and the Platform.
